Terms of Service

These Terms of Service ("Terms") govern your use of POCtix, an event ticketing service operated by Port of Cams, located in Honolulu, Hawaii, United States ("we," "us," "POCtix"). By using POCtix as a ticket buyer or as a participating venue, you agree to these Terms.

1. What POCtix is

POCtix is a ticketing platform that lets event organizers ("Venues") sell admission to events, and lets buyers ("Buyers") purchase those tickets. All payments are processed by Stripe, Inc. under Stripe's Connected Account Agreement.

2. Accounts

Buyers

You do not need to create an account to buy tickets. If you sign in (via magic-link email), we use a session cookie to show your order history. You can sign out at any time.

Venues

Venues must apply through our intake form and be approved by POCtix. Approved Venues connect a Stripe account; all ticket revenue is paid directly to that Stripe account. Venues are responsible for the accuracy of event listings, fulfillment of events, and applicable tax collection.

3. Fees

Fees are subject to change with 30 days' notice. Existing event prices honor the fee schedule in effect at sale time.

4. Refunds and cancellations

Venues control refund policy for their events. POCtix supports refunds through Stripe; when a charge is refunded, the corresponding tickets are automatically voided and capacity is released. The POCtix platform fee is non-refundable by default, as it covers services already performed; a Venue may elect to issue a full refund inclusive of the fee. Disputes about refunds should be addressed first to the Venue, then to Stripe via your card issuer if unresolved.

POCtix, the POCtix wordmark, and the underlying software are owned by Port of Cams. Venues retain ownership of their event names, descriptions, logos, and customer relationships. Buyers retain ownership of their personal information.

7. Disclaimers

POCtix is provided "as is." We do not guarantee uninterrupted availability. Events are produced by Venues, not by POCtix; we are not responsible for the quality, safety, or occurrence of any event. Cancellations, schedule changes, weather, performer no-shows, and venue issues are the responsibility of the Venue.

8. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising from your use of POCtix is limited to the greater of (a) $100, or (b) the total fees we collected from you in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages.

9. Governing law

These Terms are governed by the laws of the State of Hawaii, USA, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Honolulu County, Hawaii.

10. Changes

We may update these Terms occasionally. We'll post the new version at this URL and update the "Last updated" date. Material changes will be emailed to buyers and Venues with at least 14 days' notice.
